My situation with Jay was pretty basic in comparison. I'd never dealt with him, but when he posted that he was selling off his collection, I worked out a deal that included buying his series one display header and I paid for everything.

A couple days later he send me a PM and said that he just couldn't part with the display header and would be refunding me the money for that item (which he did). Since he gave me a refund, there really wasn't anything I could do, but of course I knew from his history that he was probably lying and had just sold it to another board member for more money.

A couple days after that I saw Mike's posts banning him and knew I wasn't alone in that type of experience with him.

It's pretty clear the guy just doesn't have all his marbles, and I'm glad he was banned, but I don't want to see this forum potentially closed off to new members over him.

The main crux of my other post (which I deleted) had to do with a much more troubling experience I just had with an active board member who has a much better reputation. I recently learned that he broke our deal, lied to me about it, and quite literally stole from me.

That's, unfortunately, the third negative experience I've had with board members. (Adding in the guy who sold me a "sealed" Clark Kent mailer who didn't offer to refund my money when the mailer was rejected by AFA for being double-taped.)

I don't get this type of behavior (although in Jay's case, as I said, I think he's just nuts). We're supposed to be a small, close-knit collecting community that treats each other fairly, but it seems like a lot of posters don't see it that way.

It's hopefully being worked out. He has said he's returning the items he stole and he's said he's refunding the people he sold a copy of my stolen items from in exchange for their returning the items as well.

We'll see if it all actually happens. He's still claiming he didn't steal one of the items that he probably did, and I don't know if he sold copies of the stolen items to more than one person.

I realize this is very vague, but I hate dealing with this kind of stuff and it's still in process. I'm just extremely angry right now. I happened to find out about all of this by chance, nearly a year after the fact, and that's the only reason it came to light. I can't get over that someone from this message board who is not seemingly otherwise a crook/nut-case would lie to me so blatantly and actually knowingly steal from me.

I know it's a little late to chime in here, but I think it's necessary. Not just for the sake of James but for the sake of the small and otherwise strong community we have here. I feel like bad-mouthing shouldn't come from any direction, and while I'm not faulting anyone I feel we should at least keep things as fair as possible.

First of all, James may be a hot-head, but that doesn't make him dishonest. He might run his mouth from time to time (I've seen it, but has never towards me personally) but I've had transactions, trades, and other arrangements with him where I've had to trust him with thousands of dollars that he could have easily stolen on multiple occasions and he's never done me wrong. We've even traded expensive items and he's sent first. In terms of being ripped off, he hasn't done anything that I've seen to shake my confidence. Threatening to create a fake account to smear another member, granted that's a bit childish but after he calms down I really doubt he would do something like that, and closing off the forums to the public will likely do more harm than not in the long run. I know many people that were long time lookers before being first time posters here.

Second of all, James is very emotionally attached to his toys and that sometimes has an effect on his actions and words. He's a passionate collector and sometimes to a fault, but it is what it is. I have bought some items off him, around $800 or so, and a few days later he refunded the money and told me he simply couldn't part with them and he was sorry. Money back, no harm done except disappointment, and yes that's frowned upon in any buy/sell contractual arrangement, but hey it doesn't mean he's a thief. He posted stuff for sale because he really needed the money (he said "legal trouble") but couldn't find himself actually parting with them when the time came. I get it, most of the items in my collection I feel the same way about. I found myself in a position where I was offered something for a trade and strongly considered it but at the end of the day just couldn't do it.

Third of all, selfish isn't dishonest. People say he's dishonest because of certain behaviors, one example is one of my very best friends got a good deal on a Buy It Now for a display header and James messaged the seller, offered him double the price, and the seller retracted my buddy's purchase and sold to James instead. Sure it was a very underhanded move, but he didn't know who the other guy was and wasn't acting necessarily against the other buyer, he just knew he wanted it more and went for it. Again, selfish. But that doesn't mean dishonest. And I think his emotional attachment to this line has an effect on what he does sometimes. I'm not justifying it, in fact my buddy is still pissed off about it months later, but I still gotta try to keep things level here.

Regarding James' story about going to jail, well I will say that in the past the few times he's put many of his very valuable items up for sale were due to needing funds for legal reasons and attorney bills and other things that he's posted publicly on this forum. Marcos, I consider you a friend, and I'll tell you that if the story James gave was that he went to jail, that would not only explain the delays in his communication, but the reasoning for him wanting to sell things in the first place. Maybe you should cut the guy some slack and be a little more patient with things. Sometimes he's hard to get ahold of because he doesn't always have internet or a phone. He's had to borrow a phone before to get in touch with me, or call me from work, so I don't think he's purposefully trying to dodge communication with you.

Regarding banning him from this forum, well that's totally Mike's call. But I feel like no one was going up to bat for him and while I don't have all the details of everything that went down, I want him to at least be treated fairly in all this. I feel like tempers flared on both ends, and perhaps some words were exchanged that were uncalled for, but at the end of the day "can't we all just get along?"

I see you as a friend as well, and I totally understand you defending another friend. and yes, I agree, tempers were flared and things were said, and like you I also saw the good in him, gave him chances even after he was not allowed to be part of this forum. But once things get to the point where I am hinting towards threatening you and your household, then it has gone too far and people should know. im sure that you and I have respect for each other, and like you stated, we see each other as friends, but if I ever hinted towards approaching your house or sending someone to visit you, you would cut all ties with me and it would get personal. and that is because it no longer just involves a stupid forum argument, now we are talking about my kids and spouse.

but thanks for all the info on him and sticking up for james. I respect that. and yea, we should just all get along. you can start by showing how much of a friend you are by selling me some of your 33 backs. hahaha.

Ah, yeah I guess I missed the threats part. I did see this part:
"I have some family in LA , I already have contacted them,they will deliver those "Gulliver's" to you in person so there are no more problems between us. You can pay me back later when you get the funds"
But I guess I didn't see that as threatening, I read it as a guaranteed in-person delivery "so there are no more problems between us" - as a gesture to go out of his way, but I guess that's because I know him a little better and read it as such.

If he did threaten your household and your family, well, that's crossing the line a lot. As I mentioned before I don't have all the details, but just wanted to comment on what I've seen.

And I always sell my doubles, you never know what 33-backs I'll end up with next. emoticon

This is just my two cents on it as I don't know Jay and only had a very limited interaction with him.

The fact he sent these private messages and then sends Marcos the message he received with Gulliver's in quotes sure makes it sound like he is talking about delivering something other than toys.

Truthfully shutting the site off from the public may prevent people from wanting to sign up, but if they want in I am sure they can still sign up for an account. Have to ask Mike on that. It would be in his best interest not to sign up for another account as he is unwanted right now.

If the crime against him was weird selling tactics like refunding and not sending the item that is small, but the way it went down it seemed he was selling the item, then backing out to sell the item higher to someone else. Is this what happened? I don't know, and at this point it doesn't matter. He didn't handle the situation properly and he was banned for it. That is the way things work in forums. If you don't handle the situation and appear to have shady dealings you receive the appropriate dealing that moderators choose.
